The present conditions of sale aim to define the contractual relationship between Maison Clairon and the purchaser, and the conditions applicable to all purchases made through the Maison Clairon merchant site, whether the purchaser is a professional or a consumer.
The acquisition of a good or service through the present site implies unreserved acceptance by the buyer of the present conditions of sale.
These conditions of sale shall prevail over any other general or particular conditions not expressly approved by Maison Clairon.
The company reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the buyer’s order.

Characteristics of goods and services offered

The products and services offered are those listed in the catalog published on the Maison Clairon website. These products and services are offered while stocks last. Each product is accompanied by a description drawn up by the brand.

Our accessories

Maison Clairon accessories are handcrafted in our workshop. Each product is made to order; we have no stock, or only a few products. As a result, each piece is unique. The product may therefore differ slightly from the photo on the website.

Rates

The prices indicated on the site are in euros. In accordance with article 293 B of the French General Tax Code, VAT is not applicable to our products. Maison Clairon reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated include order processing costs.

Geographical area

The online sale of products and services presented on the site is reserved for buyers residing in France, the French overseas departments and territories or Monaco, and for deliveries required in these geographical areas. For buyers residing outside the above-mentioned geographical areas, delivery charges will be added.

Controls

Purchasers wishing to buy a product or service must:
– fill in the identification form with all the contact details requested, or give their customer number if they have one;
– fill in the on-line order form, giving all the references of the products or services chosen;
– validate their order after checking it;
– make payment in accordance with the conditions laid down;
– confirm their order and payment. Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof, and waiver of the right to invoke one’s own terms and conditions of purchase or any other terms and conditions.
All data supplied and the recorded confirmation shall constitute proof of the transaction. Confirmation shall constitute signature and acceptance
of the operations carried out. The seller will send confirmation of the registered order by e-mail.

Payment

Payments are made:
– by credit card via the online store and a secure system that uses SSL (Secure Socket Layer) so that the information transmitted is encrypted by software and no third party can read it during transport on the network.
Payment will validate the customer’s order.

Deliveries

Delivery times are 4 to 5 days.
Deliveries are made to the address indicated on the order form. Orders are sent by post with tracking number.
It takes an average of 3 to 4 working days to receive them. The risks are borne by the purchaser from the moment the products leave Maison Clairon’s premises. In the event of damage in transit, a justified complaint must be made to the carrier within three days of delivery.

Withdrawal

If the jewel is not to your liking, you have 14 days from receipt of your order to return the product and request a refund without penalty, except for the cost of return.

Accessories must be accompanied by the invoice and must be in their original condition and packaging.

Accessories must not have been worn. Maison Clairon will proceed with the reimbursement within 14 days from the day we have been informed of your decision to retract. However, shipping costs will not be reimbursed and will remain the responsibility of the customer.

Warranty

All products supplied by the seller are covered by the legal guarantee provided by articles 1641 et seq. of the French Civil Code.
In the event of non-conformity of a product sold, it may be returned to the seller, who will take it back, exchange it or reimburse it.
All claims, requests for exchange or reimbursement must be made by post to the following address:
Maison Clairon – 11 rue des récollets – 30400 Villeneuve les Avignon, within thirty days of delivery.

Liability

Maison Clairon, in the online sales process, is only bound by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, breakdown in service, or other involuntary problems.

Intellectual property

All elements of the site are and remain the exclusive intellectual property of Maison Clairon.
No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written consent
of Maison Clairon.

Archiving – Proof

Maison Clairon will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code. Maison Clairon’s computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Dispute resolution

The present conditions of online sale are governed by French law. In the event of litigation, jurisdiction is attributed to the competent courts of Paris, notwithstanding multiple defendants or the introduction of third parties.
